These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “customer”) and Maeselea, Madison Collins, and Brock Godfrey (collectively, “Maeselea,” “we,” “us,” or “our”) governing your access to and use of Maeselea.com (the “Site”), including any purchases, products, services, content, communications, and transactions offered through the Site or through third-party platforms linked from the Site (including Etsy and GoDaddy). By accessing, browsing, or using the Site in any manner, or by purchasing any product, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Site.

You represent, warrant, and agree that you are at least eighteen (18) years old, or the age of majority in your jurisdiction, and that you have full legal capacity and authority to enter into these Terms. You further represent that any purchase you make is for lawful purposes and that all information you provide (including name, address, and payment details) is accurate and complete. Maeselea reserves the right to refuse service, cancel orders, or restrict access if we reasonably believe you do not meet eligibility requirements or if any information provided is inaccurate, fraudulent, or incomplete.

All crystals and products offered through Maeselea are natural, one-of-a-kind items. You acknowledge and agree that natural characteristics—including but not limited to inclusions, striations, fissures, fractures, surface markings, pits, variations in color, shape, texture, and clarity—are inherent to natural materials and do not constitute damage, defect, or “not as described.” By purchasing, you accept the product as a unique natural item with natural variation and formation characteristics.

Maeselea provides photographs, descriptions, and measurements in good faith and to the best of our ability. However, you acknowledge and agree that color appearance and detail may vary due to device screens, browser settings, lighting, and viewing conditions. Measurements are approximate and may vary slightly. You agree that such differences do not constitute misrepresentation and are not grounds for refunds, chargebacks, disputes, or claims against Maeselea.

All prices are listed in the currency displayed at checkout and may change at any time without notice. You are solely responsible for any applicable sales tax, VAT, customs fees, import duties, brokerage fees, or other governmental charges imposed by your jurisdiction. Maeselea is not responsible for customs delays, import restrictions, seizures, or additional charges assessed by authorities or carriers.

Maeselea reserves the right, in its sole discretion, to accept, refuse, cancel, limit, or modify any order for any lawful reason, including suspected fraud, unauthorized transactions, pricing errors, inventory availability, address issues, platform outages, or violations of these Terms. Payment processing may be conducted by third-party providers (including GoDaddy Payments, Etsy Payments, and their affiliates). Maeselea does not store full payment credentials and is not responsible for third-party payment processing errors, outages, or security practices beyond our control.

ALL SALES ARE FINAL. Because Maeselea sells one-of-a-kind natural items, Maeselea does not accept returns, exchanges, cancellations, or refunds, except where required by applicable law. You agree that “buyer’s remorse,” energetic interpretations, metaphysical expectations, preference changes, or dissatisfaction do not create a right to a refund. By completing a purchase, you acknowledge and agree that you are making a final sale purchase under these Terms.

Title and risk of loss transfer to you immediately upon the carrier’s acceptance of the package. Shipping timelines are estimates and not guarantees. Maeselea is not responsible for carrier delays, missed scans, customs processing, weather disruptions, or any delivery issues beyond our control. You agree that delivery performance is the responsibility of the carrier and that Maeselea’s obligations are fulfilled once the package is tendered to the carrier with correct shipping information.

Maeselea is not responsible for lost or stolen packages after the carrier marks a shipment as delivered. You are responsible for ensuring a secure delivery location and for providing accurate address information. If you believe a package is missing, you agree to contact the carrier and/or local authorities as appropriate. Maeselea may, at its discretion, assist with carrier inquiries but is not obligated to replace or refund delivered orders.

All crystals, spiritual tools, and any language regarding energy, metaphysical properties, intentions, sound, ceremony, or spiritual outcomes are provided for spiritual, educational, and inspirational purposes only. Maeselea makes no guarantees regarding energetic effects, spiritual experiences, emotional outcomes, transformation, manifestation, or results of any kind. Nothing offered by Maeselea is intended to diagnose, treat, cure, prevent, or mitigate any medical or psychological condition, and no statements have been evaluated by the FDA or any regulatory body.

You acknowledge and agree that your purchase and use of any product is entirely your responsibility. You assume full responsibility for your interpretations, decisions, actions, and outcomes, and you agree that Maeselea is not responsible for any use, misuse, handling, storage, or reliance upon information provided on the Site, in listings, or in communications.

ALL PRODUCTS, CONTENT, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAESELEA DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MAESELEA, MADISON COLLINS, BROCK GODFREY, OR ANY OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, EMOTIONAL, SPIRITUAL, LOST PROFIT, LOST REVENUE, OR OTHER DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PURCHASE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL EVENTS, MAESELEA’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT AT ISSUE.

You agree to contact Maeselea first to attempt resolution before initiating a payment dispute or chargeback. Fraudulent chargebacks, false claims, or abusive dispute behavior may result in refusal of future service and pursuit of lawful remedies, including collection, recovery of fees, and reporting as permitted by law. You agree that attempting a chargeback for an “all sales final” purchase or for reasons barred by these Terms constitutes a breach of these Terms to the fullest extent permitted by law.

All content on the Site—including text, product descriptions, photographs, graphics, logos, branding, design elements, and original language—is owned by Maeselea or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, publicly display, or exploit any content without express written permission. Unauthorized use may result in legal action.

Maeselea reserves the right to refuse service, cancel orders, restrict access, or block users at any time and for any lawful reason, including suspected fraud, harassment, abuse, policy violations, or misuse of content. This right may be exercised without notice where permitted by law.

You agree not to use the Site for unlawful purposes or in any manner that could damage, disable, overburden, or impair the Site. You agree not to attempt unauthorized access, data extraction, scraping, reverse engineering, interference, or any activity that could harm Maeselea, its customers, or its systems.

Purchases may be processed through third-party platforms (including Etsy and GoDaddy). Your transaction may be subject to those platforms’ separate terms, policies, and procedures. Maeselea is not responsible for third-party outages, errors, policy changes, account actions, payment holds, platform decisions, or platform security practices beyond our control.

Maeselea may update these Terms at any time. Changes are effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. If you do not agree to changes, you must stop using the Site.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles, except where prohibited by applicable law.

TO THE FULLEST EXTENT PERMITTED BY LAW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PURCHASE (INCLUDING STATUTORY, TORT, CONTRACT, OR EQUITABLE CLAIMS) SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION ADMINISTERED IN FLORIDA, AND NOT IN A COURT. YOU UNDERSTAND AND AGREE THAT YOU ARE WAIVING THE RIGHT TO A TRIAL BY JUDGE OR JURY. The arbitrator shall have authority to award any relief available under applicable law, subject to the limitations in these Terms.

YOU AGREE THAT ANY CLAIM MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING TO THE MAXIMUM EXTENT PERMITTED BY LAW.

To the fullest extent permitted by law, any claim or cause of action arising out of or related to the Site, these Terms, or any purchase must be filed within one (1) year after such claim or cause of action arose, or it is permanently barred.

You agree to indemnify, defend, and hold harmless Maeselea, Madison Collins, Brock Godfrey, and all owners, operators, affiliates, agents, contractors, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or legal fees arising out of or related to your use of this site, your purchase of products, your misuse of products, your violation of these Terms, or your violation of any law or rights of a third party.

Maeselea shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, weather events, fire, flood, war, terrorism, labor disputes, supply chain disruptions, carrier delays, governmental actions, platform outages, internet failures, or power failures.

You consent to receive communications electronically and agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing. Your electronic acceptance of these Terms (including by using the Site or completing checkout) constitutes a legally binding signature and agreement.

If any provision of these Terms is held unlawful, void, or unenforceable, that provision shall be deemed severed and the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

These Terms constitute the entire agreement between you and Maeselea regarding the Site and any purchases, and supersede any prior or contemporaneous understandings, communications, or agreements, whether oral or written, regarding the same subject matter.
